Report: Court Clears Way For OZZFEST Suit
August 15, 2008MyDesert.com reports that two Riverside County men who contend that poor security was to blame for injuries they suffered at last year's Ozzfest concert in Devore, California can take all of their allegations to trial and seek punitive damages, a Los Angeles judge has ruled.
Superior Court Judge Judith C. Chirlin denied a motion by Contemporary Services Corp. of Northridge, which provided security at the event, to dismiss allegations of negligent hiring and negligent infliction of emotional distress in the lawsuit brought by concertgoers Michael McClelland and Stephen Holloway.
Holloway says he entered the Glen Helen Pavilion to attend the July 21, 2007 concert about 1 p.m. A few hours later, according to the suit, he was attacked by a young man with a shaved head and tattoos who was soon joined by other assailants, who grabbed Holloway's hair from behind and kicked him in the face, breaking his jaw in several places.
Security guards told Holloway and his girlfriend to leave and refused to write a report, according to the plaintiffs' court papers.
McClelland was similarly attacked and also suffered a broken jaw, and both additionally received bruises and lacerations, the suit states.
